Loan Agreement
CCAC Artwork Loans Policy and Guidelines:
The Constitutional Court Art Collection (CCAC) is committed to preserving, protecting, and promoting works of art that reflect South Africa’s constitutional values and its ongoing journey toward justice, freedom, and human dignity. As part of this mandate, the CCAC facilitates both incoming and outgoing loans of artworks, supporting scholarly research, public engagement, and inter-institutional collaboration, while upholding professional standards of care, documentation, and legal compliance.
1. Incoming Loans: Works Brought into the CCAC
The CCAC welcomes incoming loan proposals from individuals and institutions, subject to curatorial review and institutional capacity. All loans—whether temporary, long-term, or under evaluation for potential acquisition—are documented, handled, and cared for according to the same standards applied to the permanent collection.
1.1. Conditions for Acceptance
All proposed incoming loans are assessed with consideration for:
Alignment with the CCAC’s curatorial priorities and constitutional mandate.
Conservation requirements and material stability.
Associated costs, including transport, packing, conservation, and insurance.
Availability of appropriate storage or exhibition space.
The CCAC may also actively solicit loans from other collections for use in thematic displays, rotating exhibitions, or research initiatives.
1.2. Loan Documentation and Records
All approved incoming loans are recorded in a dedicated loans register. The following information is required and maintained:
Artist name(s), title, date, medium, dimensions, and edition details (where applicable).
Descriptive information, inscriptions, condition reports, and treatment history.
Provenance, lender details, insurance value, and agreed loan duration.
Specific terms and conditions, including display, storage, and handling instructions.
1.3. Review and Approval
All incoming loans are subject to review by the CCAC Artworks Committee. The Committee applies the same standards of review and ethical criteria used to assess potential acquisitions, ensuring that each loan advances the CCAC’s curatorial vision and public service mission.
2. Outgoing Loans: Works from the CCAC to Other Institutions
The CCAC considers loan requests from external institutions for purposes of exhibition, research, or educational programming. The safety, integrity, and contextually appropriate display of the artworks are central to any loan agreement. Artworks from the CCAC will not be loaned for private or commercial use.
2.1. General Requirements
All outgoing loans are governed by a formal written agreement, which must include:
Loan duration, with provision for periodic review and renewal if applicable.
Full insurance coverage, inclusive of transit, display, and storage risks.
A clear delineation of responsibilities relating to packing and transportation.
Facility reports, both storage and display.
Written confirmation that the works will not be used for personal, commercial, or unethical purposes.
Curatorial staff oversee all risk management protocols, including condition reporting and verification of institutional standards at the borrowing institution.
2.2. Loan Agreement Procedure
The borrowing institution submits a formal loan request and draft loan agreement.
The CCAC reviews the proposed terms and reserves the right to propose amendments.
A mutually agreed final version is signed by both parties.
A valid certificate of insurance must be submitted prior to release of the artwork(s).
All packing, transport, and storage arrangements must comply with CCAC’s conservation standards.
If the artwork(s) are to appear in printed or digital publications, a separate Reproduction Request Form must be submitted and approved in advance.
The borrower is required to notify the CCAC in writing of proposed transport/collection dates at least 10 business days in advance, to enable appropriate handover arrangements.
