In this matter, the Court held that residents with insecure tenure have a right, without the owner’s consent, to make improvements designed to render the property fit for habitation at a minimum level consistent with human dignity. The case is significant within the context of South Africa's history of land dispossessions, forced removals, racial segregation, and resultant widespread poverty, and opens up new readings of the Constitution in terms of property ownership and land distribution in South Africa.
